My thoughts? I was first drawn to this book because of the fact that Dr. Oz recommends it, and now that I have read it, I have to say it really is a wealth of information, very simple and easy to follow and it does answer quite a few questions that most of us have. It covers everything from workout recommendations to skin treatments and everything in between, and there are quite a few very helpful (easy!) tips for doing things to enhance both your aging and your health as you age.

With all the focus on the presidential race and some of the congressional elections, there are a number of important state ballot questions that we must not overlook.? Many of us claim that conservatism is not on the ballot in many states where the candidates for Congress are underwhelming.? However, there are a plethora of ballot questions that deal with taxes, marriage, and Obamacare ? issues that are of great concern to conservatives.

Here is an informal list of some important ballot questions ? some good and some bad.? We?ll update this post next week to reflect the results of the ballot initiatives and referendums.

  • Obamacare: Amendment 6 would prohibit any coercion to comply with Obamacare mandates.
  • Labor: Amendment 7 would guarantee the right to a secret ballot in union elections.

  • Obamacare: Proposition E would prevent the governor from establishing the healthcare exchanges required under Obamacare.

Montana

  • Abortion: LR-120 would require parental notification before abortions are performed.
  • Illegal Immigration:? LR-121 would require proof of citizenship in order for a person to receive certain services provided by the state.
  • Obamacare: LR-122 would prohibit any coercion to comply with Obamacare mandates.

My cousin has lactose and gluten intolerance so my aunt is also wondering if you have suggestions for child friendly dishes, both alternatives to bread because sometimes she is tired of gluten free bread, and also dinner alternatives. Of course she usually cooks normal food using gluten-free substitutes such as gluten free pasta. But she would like some other alternatives that don't require substitutes. I don't think my cousin is particularly picky, but he is quite young, only 3 years old, so he might not enjoy very "advanced" gastronomic experiences. Lactosed Out and Gluten Fed Up? Dear Lactosed Out and Gluten Fed Up, Thank you so much for your email. I?d love to help you and your aunt out with some tips on navigating a lactose and gluten free lifestyle for families with small children. While I am not gluten allergic, I was lactose intolerant as a child and remember the hassle my parents faced trying to keep me fed and happy. I?d offer your aunt some of the same advice I passed along in my blog post about dealing with picky children at mealtimes?from a few weeks ago.
Know Your Audience - Consider what your child already likes and adapt your food strategy accordingly. Give Them What They Want (But Control the Choices They Choose From) - Prepare foods or dishes that your children are already familiar with but make gluten & lactose free versions. Good examples of this are vegan lasagna and my vegan chocolate banana peanut ?ice cream?. Fruit smoothies are a good way to ?hide? healthy foods if your cousin doesn?t like vegetables and fruits on their own. Some gluten and lactose free options out there can be expensive, so make your own if you can. Ketchup and the One Spoonful Rule ? Use a portion control rule and limit your child?s intake of condiments to one teaspoon per meal or use a bigger spoon for other foods. One can also use this rule to help introduce new foods and dishes to children. Avoid Guilt, Begging or other Forms Of Bribery ? In a phrase, just don?t do it. Use positive reinforcements to help motivate behavioral changes. When Needed Seek Help ? And Early ? Ask friends, family and others such as food bloggers for their advice, tips and recipes. Plan Ahead ? Plan ahead using tools like meal planners and schedules, but only if they work for you and your family. Experiment a little to see what works. When All Else Fails, Use Humor or aka Be Sneaky ? Using a little humor to get to your goal never hurt anyone! Try mixing in goodies like spinach or squash puree into dishes when you can instead of cream, or using flour for thickening.

Here are my other tips for your aunt - Try bread alternatives such as:
  • quinoa based crackers
  • rice cakes
  • boiled rice
  • boiled quinoa
  • gluten free oatmeal porridge
  • lettuce or cabbage for wraps
  • Vietnamese spring roll wraps

Try gluten and lactose free child friendly dinner options such as:
  • Consider maintaining a gluten and dairy free diet for the entire family, too. This makes meal planning a lot easier and means that you can enjoy meals as a family with less hassle.
  • Buy a rice cooker. Rice cookers can be bought from 200 NOK and up online or in electronic stores. Asian food stores also stock a few models too. These are normally of higher quality but more expensive than the ones bought in electronic stores.
  • Crock-pots aka slow cookers are now sold in Norway, and offer you a way to get gluten and dairy free meals on the table fast (and save LOTS of money along the way). One of my favorite food bloggers Stephanie O?Dea has a GREAT blog called A Year of Slow Cooking?about the year she spent cooking in a slow cooker every single day. All of her recipes are gluten free and many have optional dairy ingredients.
  • Coconut milk is my favorite substitute for cow?s milk. It can be bought in cans in most stores in Norway and in powdered form in most Asian and African food stores in Norway. Use coconut milk as you would cow?s milk in sweet and savory dishes.?
  • Some lactose intolerant people find success with raw (non-pasteurized) cow?s milk, sheep milk or goat?s milk cheeses. These are more commonly found in health food and organic stores.

CPR less likely for minorities on street or home

(AP) ? People who collapse from cardiac arrest in poor black neighborhoods are half as likely to get CPR from family members at home or bystanders on the street as those in better-off white neighborhoods, according to a study that found the reasons go beyond race.

The findings suggest a big need for more knowledge and training, the researchers said.

The study looked at data on more than 14,000 people in 29 U.S. cities. It's one of the largest to show how race, income and other neighborhood characteristics combine to affect someone's willingness to offer heart-reviving help.

More than 300,000 people suffer a cardiac arrest in their homes or other non-hospital settings every year, and most don't survive. A cardiac arrest is when the heart stops, and it's often caused by a heart attack, but not always. Quick, hard chest compressions can help people survive.

For their study, researchers looked at the makeup of neighborhoods and also the race of the victims. They found that blacks and Hispanics were 30 percent less likely to be aided than white people. The odds were the worst if the heart victim was black in a low-income black neighborhood.

The researchers also found that regardless of a neighborhood's racial makeup, CPR was less likely to be offered in poor areas. That shows that socio-economic status makes more difference than the neighborhood's racial makeup, said lead author Dr. Comilla Sasson, of the University of Colorado in Denver.

While few people in poor black neighborhoods got CPR, those who did faced double the odds of surviving. Overall, only 8 percent of patients survived until at least hospital discharge, but 12 percent of those who got bystander CPR did versus just 6 percent of those who did not.

About 80 percent of the cardiac arrest victims in the study had collapsed in their own homes. That suggests lack of knowledge about how to do CPR. But also, people tend to panic and freeze when they encounter someone in cardiac arrest, and they need to know that cardiopulmonary resuscitation is easier than many realize, Sasson said.

She said the study results should prompt public outcry ? especially since most people who suffer cardiac arrest in non-hospital settings won't survive and those statistics haven't changed in 30 years.

"We can't accept that anymore," she said. "It shouldn't matter where I drop to have someone help me."

The study appears in Thursday's New England Journal of Medicine.

The researchers analyzed data from 2005-2009 from a cardiac arrest registry coordinated by the federal Centers for Disease Control and Prevention and Emory University. They also examined U.S. Census data in cities where study patients were stricken ? including Atlanta; Boston; Columbus, Ohio; Denver; Houston; Nashville; and San Francisco. Whether similar results would be found in small cities or rural areas isn't known.

Much of the research was done before experts changed CPR advice in a move many think may encourage bystanders to offer help. American Heart Association guidelines issued in 2008 emphasize quick, hard chest compressions rather than mouth-to-mouth resuscitation ? removing some of the discomfort factor.

CPR specialist Dr. Dana Edelson, an assistant professor at the University of Chicago Medical Center, said the new research echoes smaller studies showing bystander CPR depends on neighborhood characteristics, including a Chicago study that found intervention occurred most often in integrated neighborhoods.

"Nothing that we do has as big an impact on survival as CPR, and it's so cheap," Edelson said, noting that online videos demonstrate how to do CPR.

It involves pushing hard and fast on the victim's chest; research has shown using the beat of the old Bee Gees song "Stayin' Alive" is a good guide.

"It's your ultimate low-budget solution to improving survival," Edelson said.

Dr. David Keseg, an emergency medicine specialist at Ohio State University, has helped teach CPR to eighth-graders in inner-city Columbus, Ohio. That includes giving them free classes and CPR kits.

"We tell them to take them home and show their families and neighborhoods how to do it," Keseg said.

"It's kind of a drop in the bucket," but it's the kind of targeted approach that is needed to improve the odds of surviving a cardiac arrest, he said.

Smartphones aus dem Jahr 2011 m?ssen mit Android 4.0.4 auskommen. Ein offizielles Update f?r Modelle aus dem Jahr 2011 sei laut Sony nicht geplant, da man durch Android 4.1 keine Verbesserung der Benutzererfahrung erreichen k?nne.

Matching Your Services to Your Clients' Finances (Long Post) | Solo ...

This post is not for the faint of heart. Nor is it a political post. ?It is a cold hard look at statistical data (which I?m sure you can supplement anecdotally) on what is happening to wages in this country.? And what a (potential) client earns directly impacts the route they will take to address their?legal needs.

Unless you live under a rock or walk through life with your ears covered and your eyes closed singing la-la-la. you would be hard pressed not to know?there is staggering unemployment in this country.

The National Employment Law Project has just released very sobering statistics. According to this report,?58 percent of the jobs that have been created since the end of the recession have been low paying jobs.??Let?s define a ?low paying job?. The National Employment Law Project defines it as a job with an hourly wage between $7.69 and $13.83.??If you were working a full time job, with full time hours for an entire year, your annualized earnings at the top end?of this range would be?$28,766.40.? To put things in perspective, the federal poverty level for a family of five is $27,010.?It?s fair to say that these newly created jobs don?t?pay what is required to support a traditonal middle class way of life.? In fact, it is?swelling the ranks of ?the working poor?? and increasing the number of Americans requiring government assistance.??

More startling are these numbers compiled by the National Employment Law Project .??During the recent recession, most jobs lost?were mid-wage jobs. Most jobs created since then have been low wage jobs.?This alters our economic landscape dramatically. Here are some highlights from the report:

-21 percent of the jobs lost during the last recession were low wage jobs paying between $7.69 and $13.83 an hour.

-58 percent of the jobs created since the end of the recession have been low wage jobs paying between $7.69 and $13.83 an hour.

-60 percent of the jobs lost during the last recession were mid-wage jobs paying between $13.84 and $21.13 an hour.

-22 percent of the jobs created since the end of the recession have been mid-wage jobs paying between $13.84 and $21.13 an hour.

The numbers at the higher end of the mid-wage pay range are not that uplifting, either.

If you have a position which pays $21.13 an hour and you work your full-time hours, you will receive $43,950.40 annualized.

You can conceivably support a family of four in some, or even most, parts of the U.S., but it?s fair to say you will?be living at the lower end of the middle class life style.

But the most important take away is this: A full 80 percent of all jobs being created are paying $43,950.40 or less and the number of ?good? jobs (currently at less than 25%) is declining, too.

This is the financial future of most of your clients, the very clients who will need your legal services more and more as life continues to get incredibly complicated.

The reality is slowly hitting the majority of people: workers in this country are no longer valued.? Less and less are receiving health care or retirement packages.? So, of this top range of $43,950.40 pre-tax, these?workers will have to pay for their own health care as well as figure out their retirement.? How are they going to squeeze out dollars to pay a lawyer for that?estate plan?or to defend that DUI or handle their divorce or incorporate their fledgling business or protect their trademark?

This is the fundamental reason LegalZoom and their ilk are poised to make?a serious?land grab.? It is why large box stores like Walmart could be positioning themselves to provide legal services.? It?s why there is such a battle royale going on to prevent non-lawyer investors from entering the legal space. Big money is in tune with demographics and economic changes in a way that our profession is not.? They explore every area to compete and increase their market share and profit and they don?t care who they steamroll over to do it.? The legal space is incredibly vulnerable because of the ?we?re a profession and not a business??slogan which is mentally tattooed on almost every lawyer over 35.? The ?business? models are old, top-heavy and the resistance to change is legendary. Those educating future lawyers are guilty of the same.

The Need For Legal Representation Is Not Disappearing. It?s Increasing

The need for legal?representation is not disappearing.? In fact, it?s necessity is increasing.

The increase in self-represented parties stems from a recession that has left fewer people able to afford lawyers and created new waves of foreclosure, debt collection and bankruptcy cases, judges and lawyers say. Judges say self-represented people are slowing down court dockets because they typically don?t know what legal points to argue or what motions to file.

But the traditional business models are terribly flawed. The traditional delivery costs are no longer supportable in this post-recession economy.? They say your services are only as valuable as those willing (or able)?to pay for them.? This well is drying up.

What Can You Do To Compete?

As I?ve written here, don?t fear the forms companies.? Right now these companies?still lack what you have to offer IF you handle your business properly and make inroads in?educating consumers on the difference(s) between them filling out a generic form and you providing counseling and advocacy and guidance through the?legal thicket.??Consumer Reports also confirmed that legal forms websites were no match for professionals . We still live in?a society where the?majority of consumers believe they need a lawyer for legal?services?even though they struggle to pay the?legal bill.??Right now you are still relatively safe from the the known?forms companies because they have yet to fully realize their own shortcomings and do something meaningul about it.

However, there is a new beast on the block.? Maybe others didn?t hear the alarm bells ringing when this news came out, but I find this new venture by Jacoby and Meyers more threatening than the LegalZooms of this world?could ever be.

Because Jacoby & Meyers is a law firm, it offers not only customer service, but will also have lawyers available to provide legal advice about the legal forms that they sell, giving the firm a competitive advantage.?? Many consumers and small business owners do not seek out the legal services they need because they?re afraid it?s too complex, confusing or unaffordable.? ?This expansion is all about giving the public, especially average citizens and small businesses, access to affordable, quality legal representation,? said Len Jacoby, founding partner of Jacoby & Meyers.

There is a huge difference between LegalZoom and their kind and what?Jacoby & Meyers is doing.??Forms companies make their bread and butter from selling forms.? Harnessing a stable of usually low-priced lawyers to answer questions and maybe garner a client or two isn?t there main selling feature but an add-on.? They attract the DIY crowd who avoids using a lawyer even though they might need one content with what they don?t know until it?s too late.? This?leaves a huge gap?unfilled?between the full-service?lawyers and the DIY?s. J&M has created a strategic relationship with USLegal Forms. As a result, they will have access to thousands of forms, offering three choices: a do-it-yourself option, an attorney consultation option and a full service lawyer/client option. This client perception combined with the power of the J&M?marketing machine?and their national reach is by far more threatening to solo and small firm lawyers who cater to the consumer than the LegalZooms of this world.? J&M also doesn?t have to deal with non-lawyer investors at this point, either.? They?ve jumped the hurdles?others are facing and did it with a single?strategic relationship?and?reengineering of their business plan.

This is the?real carnivore?consumer lawyers need to fear (even if their website is atrocious).

But it?s not all doom and gloom. When J&M was just J&M sans legal forms, they didn?t own the consumer legal arena.? And when they start marketing their forms business nationally all consumers won?t be flocking to work with them. They can have their big piece of pie and still leave a nice slice for you.

What do you need to do?

Look at your current business model and see how it needs to be reworked to cater to today?s economically-challenged client.?J&M is offering three ways to work with their firm; 1) Use their forms, 2) Use their forms and meet with an attorney on a consulting basis and?3) Full service.

When you look at your current practice areas and how you have structured your services, are you offering a comparable way for potential clients to work with you??Do you have more than one way a client can retain your services? Are there different fee structures for different levels of service?? Can you (and are you willing to) create this type of structure? Can you create this type of structure AND make it affordable to the client while still earning a living? Are you willing to pivot?

These are the questions you need to ask yourself.? And you need to start now. There is still time.? Just because we are watching the birth of the legal behemoths doesn?t mean there isn?t room for you to grow. They are?still in their infancy.?Understanding what you are up against and accepting it is half the battle.??Addressing?the issues head on and acting upon it is the critical next step.

Scientists face verdict for failing to predict Italy quake

A court in the Italian city of L?Aquila is expected to hand down verdicts on Monday to six scientists and one government official charged with manslaughter for failing to give sufficient warning of a fatal earthquake that hit in 2009.

The case centers around a meeting the seven defendants, all members of a commission on natural disasters, held in L?Aquila on March 31, 2009, in which they told residents there was no cause for concern after a series of minor shocks had rocked the city in the preceding six months.?

In the early hours of April 6, a 6.3-magnitude quake?reduced much of the medieval city to rubble, leaving 309 people dead and more than 60,000 homeless, according to news reports at the time.

In a memo issued after the March 31 meeting, the seven experts concluded that it was "improbable" that there would be a major quake, although they stopped short of entirely excluding the possibility.

The public prosecutor, Fabio Picuti, has accused the defendants of giving "inexact, incomplete and contradictory information" about whether the smaller tremors should have constituted grounds for an official quake warning.

Picuti said he realizes that predicting where, when and with what force a quake would strike is beyond the current abilities of science, but stresses that the risk of a big quake was not taken seriously enough. He argues the commission?s discussions, as recorded in its official minutes, were too generic and completely failed to address the risk at hand.

Italy's long earthquake history hidden in ancient records

Some of those affected by the quake claim the commission?s reassurances had influenced their decisions.

?We were comforted and reassured by the statements of these scientists, therefore that night we stayed at home,? said Anna Maria Cialente, mother of one of the victims. ?My son was confident in the words of these experts? and he was persuaded to stay at his student house which collapsed.?

Scientists on trial for failing to predict Italian quake

Although much of the scientific community has expressed outrage at the trial it has focused international attention on the ability of seismologists o predict earthquakes and the way in which their warnings should be communicated.

In a report?commissioned by the Italian government in the immediate aftermath of the L?Aquila disaster, the International Commission of Earthquake Forecasting for Civil Protection (ICEF) highlighted the many difficulties of making accurate time-sensitive predictions, within timescales usually calculated in decades, not weeks or months. ?

But the ICEF report?s findings also called for better public communication, not just of the day-to-day hazards but also by setting alert levels that take into account the advantage of being psychologically prepared for when the quake hits.

Insight: Is Ohio's "secret" energy boom going bust?

NEW YORK (Reuters) - Dozens of wells drilled this year across rural Ohio are quietly pumping out the answer to the U.S. energy industry's most loaded question: Is the Utica shale formation, touted as a potentially $500 billion frontier, a boom or a bust?

Yet the answer is likely to remain concealed for some time.

More than a year after Chesapeake Energy Corp Chief Executive and top Ohio driller Aubrey McClendon declared the Utica to be "the biggest thing to hit Ohio since the plow," investors, landowners and even the federal government are still in the dark over the true pace of oil and natural gas production in the state.

That's because Ohio is one of the nation's least transparent states when it comes to energy data - a distinction the industry worked to maintain this year, according to a review of legislative documents and interviews with state and industry officials.

Secrecy still surrounds the most eagerly anticipated drilling campaign in the country, one that began in the middle of last year when McClendon boasted that the 1.3 million acres of land the company had leased could hold oil and gas worth $20 billion.

Months later, with drilling into the 8,000-foot-deep (2,500- meter) formation just starting, he said the Utica - centered under Ohio but reaching seven other states and Canada - probably held hydrocarbons worth $500 billion.

By this spring, a new energy bill being crafted by lawmakers initially included a clause that would have allowed regulators to publicly disclose quarterly energy production data. The current requirement calls for annual reporting.

But the clause was struck from the bill after discussions with the industry, a Reuters investigation has found. Instead the law, which took effect in August, explicitly bars the government from publishing the quarterly figures it now obtains.

Almost every other energy-producing state releases production data and drilling results on a monthly basis; even Saudi Arabia now self-reports its once-secret production volumes once a month. The latest Ohio figures for 2011 provide information on only five wells. The volume of oil and gas pumping out of dozens of new wells drilled this year will not be available until April 2013, as much as 15 months after they were drilled.

In Ohio, companies control the flow of information, and their selective disclosure is creating doubts about Utica's ultimate bounty. It remains unclear whether the Utica will be a major winner for companies who have invested billions of dollars leasing land and drilling there, and for the state's finances, or if it will turn out to be a relative flop.

Drillers such as Devon Energy Corp and Anadarko Petroleum Corp have released information on only about half the 33 wells now producing in the Utica, according to a Reuters review of company filings and state data. The data is often limited, and the companies have no regulatory obligation to divulge the results of every well they drill.

"It gives investors a little bit of concern because you don't have any independent, third-party reporting on any of this data," said Leo Mariani, an analyst at RBC Capital Markets.

"You are reliant on the companies coming out with the data as they see fit to report it. It adds a level of incremental ambiguity."

The growing concern among many is that the Utica, far from being the oil-rich patch originally believed, is largely filled with natural gases and related liquids, whose prices have slumped to near break-even rates for drillers.

Some recall the dramatic boom and bust of Michigan's own shale play two years ago, which fizzled in just months after promptly reported well data showed disappointing results.

The lack of transparency risks testing shareholders' patience for returns on the billions of dollars spent leasing land across the state. It may also put drillers at odds with landowners.

"The industry has lobbied very heavily in Columbus to keep this reporting requirement down to an annual basis," said Ohio Representative Mark Okey, a Democrat, who voted against the bill.

"How are people supposed to understand what their potential royalties might be if there is not reporting on a more frequent basis?"

'NOT QUITE LIVING UP TO ITS PROMISE'

Chesapeake led the charge into Ohio, and others quickly followed. France's Total paid $2.3 billion to buy a share of Chesapeake's holdings, while major oil companies such as Exxon Mobil, Chevron and Anadarko joined in. Minors like Gulfport Energy Corp and Rex Energy Corp are also present.

Since then results have been mixed.

One of the first five Chesapeake wells in the Utica - called Buell 10-11-5 8H - spewed an impressive 9.5 million cubic feet per day of natural gas, according to data released by the Ohio Department of Natural Resources (DNR) in April. But with gas prices trading this spring at their lowest in a decade, the news spurred little enthusiasm.

In August, Devon said results from two wells in the western, oil-rich sections of the Utica were not encouraging.

Well permits, which hit a record high in August after doubling since the start of the year, dipped in September.

Marathon Petroleum, the Midwest's largest refiner, recently made changes at its 78,000 barrel-per-day refinery in Canton, Ohio, anticipating increased Utica crude output. So far it only processes 1,500 bpd of Utica oil and condensates.

"I would say the growth has been slower than we originally anticipated," Donald Templin, Marathon's vice president and CFO, told an energy conference last month.

Even Chesapeake has muted its trumpet.

In an SEC filing this May, the company said it was planning to drill a significant number of wells in Utica's "oil window" over the rest of this year, referring to an area that is expected to hold mostly oil. Three months later it said it "continues to focus on developing the wet gas and dry gas windows," with no mention of oil. Chesapeake declined to comment on the change in description.

Early comparisons between the Utica and the prolific Eagle Ford shale play in Texas are looking increasingly tenuous.

In 2011, one year after shale drilling commenced in earnest in the Eagle Ford formation, oil production had surged tenfold to nearly 120,000 barrels per day, state data show. It has pumped almost 300,000 bpd so far this year.

Ohio pumped around 13,000 bpd last year, a volume that has been almost unchanged for a decade, according to the U.S. Department of Energy. More recent figures are unavailable.

"Initial indications are that it is not quite living up to its promise," said Phil Weiss, an energy analyst at Argus Research in New York. "The Utica does not appear to be comparable to the Eagle Ford, but there is so little data."

'HYPER-COMPETITIVE PLAY'

With Ohio in the grip of a hydraulic fracturing boom similar to the sudden expansions that have transformed Pennsylvania and North Dakota, pro-drilling Ohio Governor John Kasich raced this spring to put in place new regulations, including forcing companies to disclose what chemicals they used in the process.

The first version of Senate Bill 315 also included a clause that required energy companies to provide production data to the DNR at the end of every quarter, not once a year by March 31.

But industry groups wanted to alter the clause to ensure well data remained private, and it was dropped in later iterations of the bill, documents show.

"Companies wanted to continue to report on an annual basis," said Thomas Stewart, executive vice president of the Ohio Oil and Gas Association. "It is a hyper-competitive play, and people who were making those investments on the ground did not want to be publishing that data on a quarterly basis to give their competitors an edge." The association represents producers including Chesapeake Energy, Anadarko Petroleum Corp and Devon Energy.

The law still requires companies to report production data each quarter to the state tax department, which is allowed to share that information with the DNR for budgeting purposes. But the DNR is prohibited from making that data public.

Craig Butler, assistant policy director in the governor's office, said they were "comfortable" with the outcome, which at least provided more frequent data to state authorities.

A spokesman for Chesapeake Energy, which operates 25 of the 33 producing wells in the Utica, said the company did not ask industry groups to oppose the original clause. He declined to comment on the bill, the disclosure requirements, or the company's progress in the Utica.

McClendon himself says secrecy actually benefits his shareholders. He said in November that Chesapeake would stop reporting well-result details to investors because positive well data were driving land prices higher.

With minimal requirements for companies to report their activities once they secure a drilling permit, Ohio's own DNR often relies on company press statements to glean information on the numbers of wells that are being drilled, officials say.

In Carroll County, the heart of the boom with 20 producing wells and another 150 permits to drill, commissioners have no idea about the Utica's progress.

"We don't know what they're producing because they don't tell you until they need to," said Tom Wheaton, one of the three Carroll County commissioners. "I think Ohio is protecting the industry at the state level. I don't see any other value in it except big companies controlling the competition."

Even the federal government is frustrated as it attempts to gather the data necessary to oversee a domestic energy boom that is transforming the nation.

"I think it would be really good for policymakers and the public to know what's going on now," Adam Sieminski, head of the Energy Information Administration, said this month of the need for more federal funds to track domestic energy production in general. "Particularly given the swiftness of the changes taking place."

Yet the EIA, which publishes monthly production estimates by state, says it relies on Ohio's annual year-ago figures to estimate the current year's output.

MICHIGAN EXAMPLE

Most states are sensitive to the risk of publicly releasing information on energy activities by private companies, especially on early drilling results that may tip competitors to a new hot spot. To ensure that companies are not giving away any competitive advantage too quickly, they offer a confidentiality period of three to six months before publishing any so-called initial production data. Once a well is declared commercially viable and enters routine production, most states see little need for secrecy.

In Louisiana and North Dakota, well-specific output is reported monthly. In Pennsylvania, home to the Marcellus shale that overlaps the Utica, it is every six months.

The case of Michigan's Collingswood shale provides a stark example of the power of data in the energy sector.

In January 2010, Encana Corp drilled the State Pioneer 1-3 HD1 well in Missaukee County, one of Michigan's first shale wells.

During the first production test that April, it gushed gas at an impressive 3 million cubic feet per day. Because the 90-day confidentiality period had expired, those results were made public almost immediately, prompting a frenzy of leasing that caused land prices to spike as much as 100-fold.

Output quickly dropped to less than half the initial rate, according to reports that were released in June. "After 30 days or so the trend was that the well had peaked and it was declining," said Larry Organek, an engineer with Michigan's Department of Environmental Quality.

The well was plugged, and the leasing boom came to an abrupt halt.
